Our Approach to Workplace Investigations

  • Embedding trauma informed and culturally responsive approaches into our workplace investigation methodology sets Violet Co apart from other workplace investigators.

  • Ensuring that complainants are “heard” is critical. Principal Solicitor Karen Iles leads our engagements. Having an Aboriginal woman with a lived experience of violence, builds confidence in the process.

  • As legal practitioners ensuring that natural justice, the rule of law, and workplace laws are embedded is critical and our core business.

  • Our clients are afforded client legal privilege over the investigation.

  • At Violet Co we specifically investigate sexual harassment and assault, discrimination, bullying, and other gender or race-based issues.

  • We create our investigation methodology, scope and process in consultation with our clients to ensure that our processes aren’t “cookie cutter”. Each workplace is different and deserves a bespoke approach that is responsive to your policy, industrial context and culture.

Who do we represent as clients in workplace investigations?

  • We are engaged by organisations and businesses to conduct workplace investigations.

    The complainant and respondent are not our “client” in this arrangement.

  • Individuals engage us to help support them in a workplace investigation. Often our support for our clients is “behind the scenes”. We assist to formulate a complaint, or respond to a complaint, and participate as support people to enable an individual to debrief an investigation process.

Workplace investigations for organisations & businesses

Workplace Investigation - commencement process for organisations and businesses

We create bespoke workplace investigation processes for each client.

An exploratory meeting and commencement process (3 hours in total) for organisations and businesses is an opportunity to discuss and plan.

  • We kick-start all of our workplace investigations with the following process:

    • An initial meeting with the Organisation sponsor to share and understand the context of the workplace - policies, industrial context and culture. Provision of background documents. In this meeting we discuss the issues and best approach to a workplace investigation.

    • Finalisation of scope.

    • Communications to parties regarding the investigation and appointment of Karen Iles as the lead investigator.

    • Initial 1 hour meeting with complainant to understand the complaint, ensure they are comfortable with the process and that their needs are accommodated

  • An exploratory meeting and commencement process (3 hours in total) for organisations and businesses is an opportunity to discuss and plan.

    Our fees cover:

    We then charge for our services on an hourly basis, or fixed-fee, depending on our clients needs. Our fees for our workplace investigation commencement process are discounted down to a fixed fee of $1,200+GST.

Individuals - complainants & respondents

We support individuals in workplace investigations.

Workplace investigations can be serious, stressful, confusing and complicated. Our team supports individuals - complainants and respondents.

  • Our fees cover 3 hours of legal advice and representation:

    • An initial meeting

    • Review of documentation

    • Support to document a complaint or respond to a complaint

    • Debrief meeting after workplace investigation interview

  • Our fees cover 3 hours of legal advice and representation.

    Our fees to represent individuals in workplace investigations are discounted down to a fixed fee of $1,200+GST. Beyond this package we then charge for our services on an hourly basis, or fixed-fee, depending on our clients needs.
